1991/03/13Commissioner Russak commented that he is awaiting ~larification from Attorney Sullivan to the Zoning Commission concerning the question of whether a commissioner can give testimony at a public hearing of.a commission of which he is a member. The objection of Commissioner Messina's giving testimony as a resident at the public hearing of tile application of Fox Hill Land Co. to change the zone on Spruce Brook Road from R-43 to R~2I was stated in a letter January 7, 1991 from Attorney Jeffrey Cugno to Chairman Suranna. The date of the hearing at which Mr. Messina spoke was November 28, 1990. Town Planner Voelker stated a response is forthcoming. Acting Chairman Query requested the item be placed on the next agenda. A motion to adjourn the meeting was made by Commissioner Kearns and seconded by Commissioner Russak. Commissioners in attendance: Robert Baumann, Kate Ke0rns,:-ISaFiMessina, Nisar Mian, Paul Query, llenry Russak,' and Dominie Y~ino '. William Voelker and Zoning Inspector Roger Gaudio were also in attendance. No citizens requested to speak fey the Audience of Citizens. The minutes of the February 13, 1991 meeting were reviewed and a motion to accept them as amended was made by Commissioner Keavns, seconded by Commissioner Russak, and carried unanimously.. The minutes of the F~bruary ~7, 1991 meeting were reviewed and a motion to accept them as amendod was made by Commissione~ Query, seconded by Commissioner Russak, and carried unanimously. Planner Vo~lker stated no new applications had been received. Roger Gnudio reviewed two ZBA applications before the ZBA for its March me,ting. Due to his work affiliation with Northeast Service Co., Commissioner Baumnnn abstained ·from discussion of the ZBA application of tho SNET Co. Tho Election of Officers was then held. A motion to nominate Joseph Suranna a~ Chairman was made Commissioner Russak, seconded by Commissioner Query and carried unanimously. A motion to nominate Commissioner Baumann for Secretary was made by Commissioner Messina ~mmisslonev Baumann withdrew his name); a motion was made by Commissioner Russak to nominate Commissioner Query as Vice-Chairman; the motion was seconded by Commissioner Kearns and carried unanimously. A motion was made by Commissioner Query to nominate Commissioner Baumann for Secretary; the motion was seconded by Commissioner Russak and carried unanimously. Chairman Suranna requested the application of Joseph and Stanley Wisniowski to change the zone of Lots 3 and 4 , Kensington Road from R-43 (Residential 43) to R-21 (Residential 21) not be considered ut this meeting as both he and Commissioner Baumann had not attended the public hearing and would like to listen to the tape of the hearing and review the file so they may be voting commissioners for this application. Commissioner Query requested that a map depicting the accurate delineation of the aquifers and water sheds be sent to the commission for review, us testimony given nt the public bearing stated a potential threat to the aquifer. Planner Voelker stated there Is no map with an accurate representation available; however, there is a map with representation of the delineation of the water shed areas around the well heads. He stated a copy of this map would be sent to the commissioners. Chairman Suranna then read into tile record a letter froln Commissioner Kearns disqualifying herself from consideration of Mr. Wlsniowskl'e application; she explained her reason for doing this was her potential business association with Mr. Wisniowski. The meeting adjourned at 8:05 p.m.. The March 27, 1991 Regular Meeting of the Berlin Zoning Cqmmission was called to order by Chairman Joseph Suranna at 7:00 p.m. in Room 7. Also in attendance: Commissioners Robert Banmann, Kate Kearns, Sa[ Messina, Nlsar Mien, Dominic Yovlno. Absent: Commissioners Paul Query and ilenry ltussak. No citizens requested to speak for the Audience of Citizens. The minutes of the Marct~ 13, 1991 meeting were reviewed and a motion to accept them was made by Commissioner Baumann and was seconded by Commissioner Messina. The motion carried unanimously. There were no new applications. Chairman Suranna advised the commissioners that a Freedom of Information Seminar would be held on March 28, 1991 at tile Marriott, Farmington. The application of Joseph and Stanley Wlsniowski at Lots 3 and 4, Bleak 73 Kensington Road from R-43 to R-2.1 was then discussed. Chairman Suranna stated he had not had an opportunity to listen to the tape of the public hearing and review the file of this application. Commissioner Baumann had done this on March 28, 1991. The consensus of the commission was that, aa Commissioners Query and Ruasak wars absent and having more peopls who could add to the discussion could be beneficial in maktnga decision, ;. discussion of this item would be tabled. Fill permit application of the Mattabass~tt Sewer District to deposit 18,000 cubic yards of material at Lot 2, Block 75A on the north side of Route 72 approximately 2000 feet from the intersection with New Britain ltoad.
