The permittee agrees to require anyone adding materials to the site to observe all stipulations. g. Item I1 Zoning Board of Appeals cases were reviewed. a. Mr. Ron Lamarre of Vivian Drive spoke to the Commission and expressed his concern over the ZBA decision regarding Patrick & Vivian English which created two non-conforming lots by splitting up one existing conforming parcel on Vivian Drive. The Commission voted unanimously to sue the Zoning Board of Appeals because the decision is in clear violation of the Zoning Regulations and there was no hardship shown. Commissioner Ferraguto will meet with the Mayor and ask the Executive Board for the appropriate funds. b. Ail other cases were reviewed. Item III The Commission discussed existing gravel banks that do not have permits because they are on "farm land" and are not covered under the existing Zoning Regulations. Emil Carlson cited Section 11.27 of the Zoning Regulations that calls for "plans...showing the extent of excavations contemplated". Within 60 days of the date of the Zoning Regulations. Commissioner Ferraguto will research past legal decisions"~ ~mc$~de if the Commission can take any action against existing pit~ w~th~ obvious safety concerns. Item II The Commission met with John Kilroy of the New Britain Herald to discuss the scheduled Public Hearing on November 17, 1986 concerning the proposed zone change PS-3 which would allow Shopping Centers and/or Office Parks on two large parcels of land. The Commission's intent by meeting with Mr. Kilroy was to provide him back up on the history behind this new regulation proposal. In addition, the Commission will provide Mr. Kilroy with a list of procedures that will be followed at the Public Hearing. Item III The following bills were approved: New Britain Herald - $43.20 Item IV The Commission recessed for a Public Hearing on the following: W. Cieniewicz - Zone change R-21 to R-15 Mohegan Land Corporation - withdrew request. Item V New applications were received. a. William A. Albert, 243 West Lane, Kensington, Conn. - Zone change from R-43 to R-21, Lot #4 and portion of Lot 3A, Block 12 located on the south side of West Lane (300 feet south), 450 feet distant from the intersection of West Lane with Chamberlain Highway. A list of procedures was agreed upon.
