1979/12/26December 26, 1979 A meeting of the Berlin Zoning Commission was held on December 26, 1979. Chairman Probst called the meeting to order at 7:30 p.m. Present were Commissioners Pegolo and Ross. Also present Alternate Warner and Emil Carlson, Zoning Inspector. Item 1 Minutes of the November 28, 1979 meeting accepted as read. Item 2 Chairman Probst read a reply by the Zoning Inspector, Re: Casimer Kurcharczyk, of 547 Nor.t~oad complaint that farmer Munson Was stockpiling manure across the street from his home. Letter placed on file. Item 3 Chairman Probst read a letter from the Building Inspector, Emil Carlson, to Charles Genoni Re: Fill Removal Permit for the Rudnick Property Bond. Relying on Attorney L. J. Fagan's opinion "the conditions upon which the above caption permit was issued have been fully satisfied" the Zoning Commission voted to release the bond covering the gravel removal on Lot # 11, Block # 71 and owned by Elizabeth Rudnick and located on Norton Road, Berlin, Connecticut. Item 4 Chairman Probst read a letter dated November 30, 1979 from the State of Connecticut Division of Criminal Justice Re: State vs Irene Upham. Irene Upham was arrested on or about August 27, 1979 for a Berlin Town Ordinance violation of keeping of animals. Martin P. Gold, Assistant State's Attorney advised that he has nulled this case because the proper judicial area for this type of violation is in civil court. Item 5 Chairman Probst read a copy of a letter by Harry N. Jackaway, Corporat- ion Counsel to Mayor Orlando P. Ragazzi Re: Town of Berlin vs Florence Carns Re: the use of a trailer as a reSidence Wilcox Avenue East Berlin. Judge Kelly requested that briefs be filed on or before February 8, 198( and be prepared to argue orally before him on this date.
