1975/11/12November 12 1975 A meeting of the Berlin Zoning Commission was held on November 12 1975 at the Town Hall This meeting was called to order at 7 30 P M by Chairman Probst Present were Commissioners Cormler McCarthy Pegolo and Ross Also present were Emil Carlson Zoning Inspector and Alternates Philip Ferraguto and David Mitchell ITEM I Minutes of the October 22 meeting accepted as read ITEM II It was voted to approve a bill for the Herald Publishing Co amount of $14 80 ITEM III Action taken by the Zoning Board of Appeals pursuant to a public hearing held on October 28 1975 was reviewed ITEM IV Commissioner Pegolo to review the proposed Inland/Wetlands pro- posed regulations and map and report at the next regular meeting NOT___~E This meeting recessed at 8 00 P M to attend a public hearing to consider the following 1 Earl H Wlcklund Inc Zone change from Residence R-21 to Residence R-15 on Lots %36 %37 %38 %40 %40A Block %151 located on the East side of Main Street East Berlin 2 John E Toffolon - Permission to f~11 clay ponds on land located East of New Britain Road Kensington Conn Berlin Zoning Commission on its own initiative to amend the Zonzng Regulations Section 4 11 - Retail Business - Permitted Prznczpal Uses - Column 2 to exclude massage parlor operation Chairman Probst read a letter dated November 10 1975 from John E Toffolon withdrawing without prejudice application for permission to fill on property located South of Route 72 NOTE Thzs meeting re-convened at 9 15 P M ITEM V Chairman Probst reviewed with the Commission Its Alternates and Zoning Inspector Public Act 75-317 entitled - ZONING-SPECIAL EXCEPTIONS OR VARIANCES-RECORDING No variance special permit or special exceptxon granted pursuant to Chapter 124 or any special act shall be effective until a copy thereof certified by a zoning commission planning commission combined planning and zoning commission or zonLng board of appeals containing a description of the premises to which it relates and specifying the nature of such variance special permit or special exception Including the zoning bylaw ordlnance or regulation which Ls varied in its application or to which a special exception Ls granted and stating the name of the owner of record is recorded In the land records of the town in which such premises are located The Town Clerk shall ~ndex %he same in the grantor s index under the name of the then record owner and the record owner shall pay for such recording Approved June 12 1975 ITEM VI Letter from Corp Counsel Harry N Jackaway dated November 3 1975 to Mayor Arthur Powers in response to bls (Mayor Powers ) question whether or not Mr Baron can legally occupy the apartment house at 406 Berlin Street after It has been vacated for a long length of t~me Mr Baron has continued to move forward w~th certain delays ~n · mprovlng and renovating the premises at the instruction of the Building Inspector of the Town of Berlin It ls Harry N Jackaway s opinion that once Mr Baron has completed the renovation to the satisfaction of the Bu~ldlng Inspector a Certlf~cate of Occupancy should be re-~ssued for the use of the premlses as a continued non-conforming use (10 apartments) ITEM VII Commissioners to revxew the present filling regulations for review at the next regular meeting ITEM VIII Next regular meeting shall be held at the Town Hall Wednesday December 10 1975 7 00 P M Mr Spielvogel will join the meetxng at 8 00 P M There being no further bus~ness the meeting adjourned
