A meeting of the Berlin Zoning Commission was held on August 27 1975
at the Town Hall
This meeting was called to order at 7 30 P M by Chaitanan probst
Present were Commissioners Cormter McCarthy Pegolo and Ross
Also present Zoning Inspector Emil Carlson

Item } Chairman probst read a letter from George A Closson concerning
23 1975 directed to Harry ~ Jackaway Corporation Counsel Closson
a dust problem h~s Webster Bquare property has been creating
informs that the site has re seeded itself and thevegetatton is two to
three feet high eliminating the problem
Commissioner Ross commented that the weed growth is sparse and the graded
slopes are completely void of any vegetation
Item III Action of the Zoning Board of Appeals pursuant to a hearing held
o~n July 22 1975 was reviewed
Item V~ An application from the McKeon Bros of 89 Harding Street
~ensiniton was reviewed requesting permission to remove gravel £rom Lot
#11 owned by Ltllian and Albert Renn located on Elton Road and as outlined
on a map
A hearing date of October 22 1975 8 O0 P M Town Hall Berlin has been set
to consider the McKeon request
Item V The Chairman reminded the Con~ission that he had conferred with
each of them regarding the action of the Zoning Board of Appeals in granting
the request of Trenner A Tomktns Birch Lane to make two nonconforming
lots out of one conforming lot and it was the unanimous opinion that the
action should be appealed to the necessary court
The chairman indicated that in accordance with the opinion of the Commission
he had immediately contacted Mayor Powers who after iiscussing the matter
suggested that the Chairman alert the Corporation Counsel which he did
On July 31 1975 the Chairman received a letter from Atty Jackaway
indicating that he would recommend to the Executive Board that no appeal be
taken
On August 1 1975 the Chairman received a letter from A B Powers Mayor
indicating that based on Mr Jackaway s opinion he would not recommend to
the Executive Board that the Zonin~ Commission be allowed to sue the
Zonin~ Board of Appeals The Chairman further indicated that the MayOr
and Corporation Counsel feel that they have authority to make such decisions
under Section 5 2 of the Town Charter
Item VI Co~issioners approved the request of the aontng Inspector to attend
~ noise seminar at the University of Corm
