1973/11/28November 28 1974 t A ueettng of the Berlin Zoning Connission was held on November 28 1973 The meeting was called to order at 7 30 P N by Chainuan Probst Present were Commissioners Cormier Pegolo McCarthy and Ross Also present were Alternates Ferraguto and Nitchell . ~mil Carlson Zoning Inspector ~te~ I Minutes o£ the November l&th meeting accepted as read Iteu II It was voted to pay a bill in mnount o£ $10 88 to the Herald Publishing Company I~em III Action taken by the Zoning Board of Appeals pursuant to their heari'ng held on November 27th was reviewed Item IV Chairman Probst read a letter £romMayor Powers dated November 19 1973 informing that it was the intention of the Executive Board to recoumend an austere budget to the Board of Finance and Town Meeting and that all Departments Boards and Commissions should develop a bare bone budget Secretary reported that 'bare bone. budget prepared by this Commission was forwarded to the Executive Board o~ November 20th ~tem V Chairman Probst informed the Commission that a publtc hearing was scheduled by the Berlin Planning C~misston to review the updated Town Plan of Development Tentative date is December 11 1973 8 O0 P M McGee School ~em VI Chairman Probst read a letter from Harry N Jackaway Town Counsel dated November 20th and an excerpt from the Corm Law Journal Vol XXXV No 21 regarding an apartment house zone case Bradley et al vs Zoning Board of Appeals of the Town of Westport et al Secretary requested to forward copies of this case to the Chairman and Secretary of the Berlin Zoning Board of Appeals Item VIIEmil Carlson reported that Earl H Wicklund Builder has ceased withdrawing gravel from his p~operty located south of Winesap Road Kensington (November l& 1973 Minutes Item 3) I_~em VIII l~ui! Carlson presented for Commission perusal an application from Bessoni and Ross for a zone change from Planned and Heavy Industry to General Cmunercial on Lot ~&8 Block 83A located on the east side of Woodlawn Road approximately 730 feet distant from the intersection of Webster Road with Woodlawn Road An application of Bessoni and Ross for a zone change on this same parcel was heard at a public hearing on July 11 1973 and denied Bessoni and Ross have appealed this decision and to date the Court has not acted upon this case Corp Counsel informed Chairman Probst that he would be unable to handle this case at which time Attorney James F Dawson was engaged Commissioners authorized Chairman P~obst to review this matter with Attorney Dawson and repor~ back at the next regular meeting Counissioners concurred that this application could not be accepted at this time ~tem IX Emil Carlson reported that Harry N Jackaway Counsel has star, ed injunctive action concerning Haman removing gravel from his property on Kensington Road without permission !rem X The petition of Eleanor R Bradley heard at a public hearing November l& 1973 8 O0 P M Town Hall Berlin Corm to excavate and remove excess material to improve the site for agricultural purposes on a parcel of land located on Kensington Road was acted upon as follows VOTED Co deny the petition of Eleanor R Bradley REASO~ Trucks enCerin$ Kensin$Con Road aC Chis point wou~d create additional safety hazards Cakin§ ~ldCh of the road and severe 90- cu~es There bein$ no further business che~eeCtn$ ad~ed pecaz'y '~
