A regular meeting of the Berlin Zoning Commission was held at
the Town Hall Wednesday September 24 1969
The meet~n~ was called to order at 7 30 P M by Cha~rman Probst
Present were Commissioners D~skln Corm~er Garllck McCarthy and Emil
Carlson Zoning Inspector

Item II The annual report of this Commission was reviewed by the
Commissioners ~nd approved
Sec~a~f ~nstructed to forward the report to the Chairman of
the Board of Finance
Item III Messrs Paskiewxcz Barberra and Duroscher members of tie
Zoning Board of Appeals met 3o~ntly w th the Zoning Commission for the
purpose of reviewing Section 11 71-01 of the Berlin Zoning Regulations
Whether to ammend th~s regulation to allow on a short term
bas~s a retailer to sell on the s~dewalk ~n front of his busines
establishment was the question This Commission (Zoning) will review
neighboring towns to Berlin and how they handle tht type of reta~llng
and a subsequent meet~n of the Zoning Board of Appeals aid on, no gommtssion
w~ll be held
Item IV Chairman Probst repot ed that he and Em I Carlson met 3ointly
w~th Sherrl Cup Counsel and Berlin Town Counsel concerning pending
~n3unct~ve action (M~nutes July 23rd 1969 It m 3)
Attorney Karanlan ~nformed that Sherr~ Cup Inc would be unable
to alter the r n~oht operations without damag~no their posit~n
Attorney Jackaway by order of Cha~rman Probst w~ll commence
~n3unct~ve action to have Sherri Cup d~scont~nue their night o erat~om
at the Hart St location
Item V Comm~ss oners reviewed the agenda of the next Zoning Board of
k'ppeals hear~n~ scheduled for September 30th
