1965/05/031. Special Meeting Berlin Town Planning Commission with the Zoning Commission on
May 3, 1965 at 8 P.M.
Present for the Planning Commission: Messrs. Csstlgltonl, Rosso, and Gsrrlty.
Present for the Zoning Commission: Messrs. Probst, Diskln, Cormter, Garltck,
Ztmmerman, and Ross.
Also Art Powers, 1st. Selectman, Morgan Seelye, DiP. of Public Works, and
A1 Curnow, Engineer tng Dept.
2. Agenda Item I - Definition and Applicst%on of Mean Widths end Depths.
Discussed in particular how the deflnltton of Mean Widths and Depths would affect
a triangular-shaped lot.
A subdivts~.on was described showing more than one lot, and with one of the lots
being trlsnguler and not conforming to mean width snd depth.
It was the consensus of the Zoning Commission that if s "lot" having the proper
acreage for the zone could be cut out of the whole lot and that this "Lot" would
have the proper mean width and depth, then it would be understood that the
remaining portion could be an "extra" to the "lot."
Zoning wil~wrlte to Mr. Sptelvogel to verify this.
3. Agenda Item II - Interpretetlon of Section 6.04.01 - 10% Variance "The minimum
lot area requirements, as variously stated in Section 4.11 may be varied by the
Planning Commission at the time of~ Preliminary Subdivision Plan approval, but
such variance shall not exceed 10%, provided the average of lots in the subdivlsio~
shall not have an area less than required by the district in which located."
The consensus of the Zoning Commission was that Planning can vary dimensions as
well as area required as long as the overall total is correct area-wise.
Again, they will check with Mr. Spielvogel.
4. Agenda Item III - InterPretation and Implementing of Section 8-26a, and
Section 8-28a of State Statutes
This is in regard to completion of subdivisions within three years after approval.
The main question is does this mean preliminary or final approval. This was
discussed et length, snd the consensus wes that we should ask the Town Counsel
for a decision.
5. Agenda Item 4 - Bulk Table Requtrments for Lot Frontages:
a) Disposition of large rear lots with non-conforming frontages -
Planning commission opinion is that this probably comes under the
Jurisdiction of the Zoning Board of Appeals.
b) Definition of "Lot" - not discussed.
