1977/04/29 MINUTES EXECUTIVE BOARD April 29, 1977 SPECIAL MEETING -~This Special Meeting was called to order by Mayor Arthur B. Powers at 8:30 a.m. Deputy Mayors Lanzoni and Dickinson were present. Mayor Powers announced that this Special Meeting had been called for the specific purpose of signing the agreement with the City of Hartford which 'would allow the Town of Berlin to transport our refuse to Hartford's land- fill site. This has come about because New Britain has been ordered to close down its landfill site on S/2/77. Mayor Powers said Mr. Jackaway and Mr. Seelye have both reviewed the agree- ment. Mr. Seelye commented on the fact that the letter of enclosure with the agreement indicates requirement for Berlin to obtain DEP approval of the agreement and necessary arrangements for disposal. Mayor Powers said he has spoken with Joseph Boren at DEP and there are no problems with this. We have written to them and the letter was hand-carried As to the agreement itself, Mr. Seelye points out that Paragraph IA excludes "hazardous wastes"; sewage sludge and septic tank cleanings; demolition materials, except those from homeowners activities; and trees and brush, aga: with the exception of homeowners. Mr. Seelye says that unless New Britain continues the dump on Deming Road for demolition materials and trees and brush, the Town of Berlin will have to provide such an area. The "hazardous" and sewage wastes are presently excluded from the New Britain landfill any- way. Mayor Powers said the asked Mr. Seelye to meet with Barry Squillaciote, Di- rector of Public Works in New Britain. I still maintain, said the Mayor, that even though the contract has run out, we can use the Deming Road dump. The Mayor said he felt we should get involved in source separation, news- paper drives, etc anyway. Also, we could go back to "clean up" weeks, there is a lot of tonnage there. Mr. Seelye's next comment was on the requirement to establish a system of permits. Mayor Powers said we are not too worried about that. We'are going to have to play some things by ear in the beginning, especially on the permits. Barry Squillaciote sees no trouble with it. If worse come to worse we will have to use a dumpster. Mr. Seelye said that the agreement specifies that the Town will pay for all wastes. We would have to then bill the permittees which would include all the commercial haulers. Mayor Powers said that is no problem since the commercial haulers go through New Britain anyway. We don't pay for independents like New Britain and Newington. Exec~utive Board Minutes ~4/29/77 -2- Mr. Seelye's memo also points out that the agreement requires an Affirma- tive Action Plan be provided and Hartford will grant us 6 months to come up with one. Mayor Powers said he had received a letter from Ronald Fletcher, Sr. Field Representative for the Commission on Human Rights, City of Hartford, in which he advises that in order to comply with the agreement and to continue using Hartford's land fill site we must present an Affirmative Action Plan ~hich is acceptable to the City of Hartford within six months. He offers assistance and/or resource in helping us to draw up said Plan. Mayor Powers said the intern from the Connecticut Conference of Municipalities will help us draw up the Plan and we can always ask Mr. Fletcher to review it. -Mr. Seelye's final comments were that the most serious problem is the need to consider the disposal of demolition materials, brush and trees. Mayor Powers commented that we can answer that problem through the use of the Deming Road Dump. Corporation Counsel Jackaway has written to advise that he has reviewed the agreement, as well as Mr. Seelye's comments. He states that he is in agreement with Mr. Seelye's comments. He goes on to say that from a legal standpoint it is the Affirmative Action Plan which concerns him most. He states: "I have no idea as to what this Commission would require from the Town of Berlin and I believe it exposes the Town to certain unknown requirements at this time." He suggests that perhaps the Commission's re- quirements should be explored before the contract is signed. Mayor Powers said he feels if we adopt a Plan similar to Newington and Plainville, we would be in the ball game. Mayor Powers said that New- ington is going to Hartford and he thinks that their Plan is acceptabIe to Hartford. Mayor Powers pointed out that there is no obligation on us to stay with the City of Hartford should something better become available. We can pull out of the contract at any time. The Mayor said he had written a let- ter to Ronald Ravizza who has land in Cromwell; but, of course, we can't wait until he gets all the necessary clearances and permits. We must go into this by Monday, May 2nd. The Mayor continued by saying that we will have to go into negotiations with Albreada for the next fiscal year (1977-78) because while he is required to transport to any site we name, we do pay him 20¢ per mile one'way which comes to about $2.40 or $2.60 and that is very low. Mr. Albreada says he will have to have one additional truck. One final comment the Mayor had was that there is sufficient money in the bud. get to cover the costs involved. We will not have to go to the Board of Fi- nance. On motion by Mr. Lanzoni, seconded by Mr. Dickinson, it was voted to author- ize Mayor Powers to sign the Agreement between the City of Hartford and the Town of Berlin for the disposal of Berlin's refuse. The Agreement is one which was sent to the Mayor by John Sulik, Deputy City Manager, City of Hartford, along with a letter dated 4/14/77. MOTION CARRIED.
