Berlin Planning and Zoning Commission Meeting Minutes - July 21, 2021
I Call to Order
The Berlin Planning and Zoning Commission held a Special Meeting on Wednesday,
July 21, 2021 in the John “Doc” McIntosh Conference Room, Room 113, Berlin Town Hall,
240 Kensington Road, Berlin, CT.
In attendance:

Commissioners George Millerd; Brian Rogan; Timothy Zigmont

a. Discussion of recent legislation with overview presented by counsel
Attorney Coppola distributed and reviewed he following:
Berlin Zoning Regulations Section XI.T. Accessory Dwelling Units
Connecticut American Planning Association 2021 Guide to Legislation
Impacting Development and Land Use Procedures dated July 2, 2021 –

III Executive Session
At 8:03 p.m. Commissioner Rogan moved to go into Executive Session with invitations to Ms
Giusti and Attorney Coppola. The motion was seconded by Commissioner Zigmont and carried
unanimously.
a. Discuss the status of the pending litigation of Rio Vista Associates, LLC v. Berlin
Planning & Zoning Commission and Town of Berlin, and possible action relating
to same.
b. Consider whether to convene in executive session to discuss the status of the
pending litigation of Rio Vista Associates, LLC v. Berlin Planning & Zoning
Commission and Town of Berlin.
At 9:00 p.m. Commissioner Rogan moved to come out of Executive Session. The motion was
seconded by Commissioner Legnani and carried unanimously.
IV Adjournment
Commissioner Rogan moved to adjourn at 9:01 p.m. The motion was seconded by
Commissioner Legnani and carried unanimously.
