2019-11-05 1NLAND WETLANDS AND WATER COURSES COMMISSION MEETING MINUTES OF NOVEMBER 5, 2019 CALL TO ORDER: The Inland Wetlands and Water Courses Commission Special Meeting was called to order by Chairman Peter Nieman at 7:00 p.m. on November 5, 2019 in Room 120 of the Town Hall. ATTENDANCE: Chairman Peter Nieman, Commissioners: David Rogan, Rick White, Gary Pavano, Michael Cassetta, William Jackson, and John Zarotney. Staff: Jim Horbal. AUDIENCE OF CITIZENS: None. MINUTES: The minutes of the October 1, 2019 meeting were previously distributed for review. Commissioner Pavano made a motion to accept the minutes of the October 1, 2019 meeting, seconded by Commissioner Rogan. The motion was unanimously approved. PUBLIC HEARINGS: Commissioner Cassetta made a motion to open the Public Hearings, seconded by Commissioner Pavano. The motion was unanimously approved. Commissioner Jackson recused himself from Application 19-09WF. Application 19-09WF - Proposal by USAAuto Sales, LLC to place fill and construct parking areas within both a wetland and a flood hazard zone on Lot 5, Block 28, 135-147 New Britain Road. Ken Cyr, Flynn & Cyr Land Surveying, LLC, presented the application. The Commission had requested that the plantings for the wetlands mitigation(in the floodway)be shown on the print, and a Best Management Practices be explained. A new detailed print and a letter from Jackson Environmental, LLC was distributed to the Commissioners showing the depictions and explaining the Best Management Practices. The Commissioners were satisfied with the information. Staff was also satisfied with the information. Commissioner Zaxotney made a motion to close the Public Hearing for Application 19-09WF, seconded by Commissioner White. The motion was unanimously approved. Commissioner Rogan made a motion to approve Application 19-09WF with Standard Conditions, seconded by Commissioner Cassetta. The motion was unanimously approved. Commissioner Jackson re joined the Commissioners at 7:08 p.m. Inland Wetlands and Water Courses Commission Minutes—November 5, 2019 Page 2 of 2 Application 19-11WF-Proposal by BT 2008, LLC to construct residential and retail improvements within both wetland and flood hazard regulated area on Lot#12, 13A and 13C, Block 83 Berlin Turnpike. Commissioner Zarotney made a motion to open the Public Hearing for Applicatiori 19-11 WF, seconded by Commissioner Pavano. The motion was unanimously approved. Attorney Peter Alter,Alter&Pearson, LLC in Glastonbury, sent a formal request to postpone the Public Hearing until they had a chance to review and comment on the peer review from WMC Consulting Engineers. Commissioner Rogan made a motion to contimie the Public Hearing for Application 19-11 WF until the December 12, 2019 meeting, seconded by Commissioner Zarotney. The motion was unanimously approved. REGULAR MEETING: Other Business to Come Properly Before the Commission: Notice of Violation-Application 12-OSWF,Lot 48C,Block 83, Christian Lane Chairman Nieman requested an update on the work at Christian Lane. Mr. Horbal has spoken with Mr. Trigilio and visited the property and is satisfied that the work is complete. Meeting Date Change Reminder Mr. Horbal reminded the Commissioners that a Special Meeting has been set for Thursday, December 12, 2019 at 6:00 p.m. in Room 120. ADJOUatNMENT: Commissioner Cassetta made a motion to adjourn the meeting at 7:12 p.m. The motion was seconded by Commissioner Pavano. The motion was unanimously approved.
