1961/09/14]. Special Meeting Berlin Town Planning Commission, September 14, 1961 at 8 P.M.
Members present: Nunzio Rosso, ~obert Bennerup~ Henry Winterbottom~ and George
Garrity. Also, James F. Kissane, Jr. Town Engineer, and Margaret Gooby.
2. C.I. Huth & Co. Zone change request - see Sept. 5 Minutes - Mr. Rosso reported
that the Chairman of the Zoning Commission had asked him if this Commission would
reconsider their action of the Sept. 5 Meeting and recommend that the Zone Change
Request be approved. This request came about as a result of the Public Mearing
on the subject.
After a thorough discussion of the subject, it was Voted on motion of Robert
Bennerup, seconded by george Garrity, that we recommend the Request be approved
and a letter be written to the Zoning Commission. We should mention in the
letter that we do not wish this action to be miscontrued to mean that we believe
this area should remain in an Industrial Zone, but that it is still our intent
that this area should be included in the General Commercial Zone when the
Proposed Zoning Ordinance is adopted; ~; this area is shown in this Zone
in the Town Plan as adopted by the Planning Commission on Jan. 1, 1960.
3. LaVictoire Property - see September 20, 1960 Minutes - Item 5. At this meeting
final approval of their subdivision as described at that time was forecast
pending approval of Health Director and furnishing of $2000 bond for their portion
of Juniper Road. To this date we do not bare that bond.
Mr. Kissane reported that LaVictoire had contacted him stating that Ravizza is
planning to have his portion of Juniper Road paved and they would like permission
to have their portion done at the same time, but they are unable to post the
bond and also pay for the paving. Mr. K~ssane stated that if they are allowed to
do the paving now, it will be done by the same contractor who will do the
Ravizza portion will will also be done at the same time, this, would, in his
opinion, give the Town a much better road than if the two portions were to be
done separately.
It was suggested that in lieu of the $2000 bond that we request a certified
check for an amount which would cover the cost of putt{ns in curbs and also any
costs which might have to be paid for repair work between the time the road is
completed and the Town accepts it. This is in line with our principle of
retaining $1000 or 10% of a Bond until a Road is accepted.
On motion of R. Bennerup, seconded by H. Winterbottom, it was Voted~ that we
would accept a certified check for $100 or $200 depending on whether curbs are
installed at this time, along with an accompanying letter stating that the check
could be cashed if the need should arise.
Upon receipt of this Check the Map can be given final approval.
4.Mr. Philip Lund, Spruce Brook Road. Mr. Kissane reported that Mr. Lund wishes to
divide his property into two pieces. As this parcel was part of a larger parcel
owned by Mrs. Shepherd, this dividing would consitiiute a Subdivision.~r.Kissane
presented a sketch showing the new boundary lines. On motion of G.Garrity,
seconded by R.Bennerup, it was Voted to give preliminary approval subject to the
approval of the Health Director.
5. Brook Side Park - Mr. Kissane presented the following new map for discussion
"Map Showing Property of Robindale Road to be transferred from Walter J. Zuk to
Johnson Enterprises, Inc.; Tanager Construction Co. Inc. to Johnson Enterprises,
Inc.; and Town of Berlin to Johnson Enterprises, Inc; and Town of Berlin to
Mercedes R. and Harold B. Kane, Berlin, Conn., Sept. 12, 1961, Scale 1"=30'."
Because at this date title to all the land which is included in Brook Side Park
is not clear - especially that belonging to the Town of Berlin as shown on this
map, it is not possible at this time to give final approval to Brook Side Park,
Section I. Johnson Enterprises will be informed of this.
6. Discussion on revised Subdivision ~egulations - the revised Regulations are
now ready for typing and will then be presented at a Public Hearing.

Jr.~ Town Engineer and Margaret Gooby.
2. Mr. Bennerup was appointed Acting Secretary.
3. The Secretary read the Call of the Meeting - copy of which is attached
to these Minutes.
4. Mr. Domler presented the following map "Section VII Block 38 Madison Estates
Property of Madison Homes, Inc., Hart Street, Berlin~ Conn., Scale 1"=40'
Date February 1961~ Revised Sept. 1961 Survey by Harold R. Sanderson, C.E.$,L.S."
5. Mr. Domler spoke for the proposed re-subdivision stating that they wish to
enlarge lots nos. 45 and 46 for better lot line alignment.
6. No one spoke against the proposal.
7. On motion of R. Bennerup, seconded by H. Winterbottom~ the re-subdivision of
Section VII was approved as submitted. So. Voted. The map was signed by
Commission members present.
