1976/09/07 111 September 7, 1976 Meeting of the Inland Wetlands and Water Courses Commission was called to order by Chairman Bengston at 7:40 p.m. at Town Hall. Those in attendance were: Commissioner Bergstrom, Commissioner "und, Commissioner Paskiewicz, Commissioner Wiezalis and Chairman Bengston. Attorney Gersten of Gersten, Butler and Gersten was also in attendance. Chairman Bengston stated that application for alteration of wetlands, contour of 72 block 23A, had been received. Mr. Gersten is requesting a summary ruling for his clients David Chase and Frank Beckerman, who are interested in selling this property to the Grove Hill Clinic for parking facilities. The property is adjacent to Grove Hill to the south east, north of Route 72. Chairman Bengston and Commissioner Paskiewicz met with Mr. Gersten and the representative of the Grove Hill Clinic and reviewed the area involved. Mr. Gersten explained that the entire area had at one time been owned by his clients and that they were approached by the Grove Hill Clinic people to see if the land could be acquired for parking purposes. He stressed the need for expanded parking at the Grove Hill Clinic. He stated that there is already a 50 foot reserve for a driveway into the property. He presented a sketch of the property in question and stated that this would be the only appropriate use for this property. Mr. Gersten explained that after discussion with Mr. Kendrick the conclusion under Section 5 of the Commission's Regulations, read together with 2.56, the intended use would not have significant impact or major affect on the area. Grove Hill Clinic has indicated that it would only have use for the area on the westerly side of the property down about 400 feet. They intend to put a driveway in along the 50 foot reserve and have the personnel utilize this area and leave the present parking facilities for the patients. Mr. Gersten stated that Chairman Bengston and Commissioner Paskiewicz had indicated in their review of the property that there would be little sight work if the parking is located between contour lines 262 and 248. Commissioner Paskiewicz stated that the area is dry and there is no evidence of a wetlands area at all in the proposed section. He asked Mr. Gersten if approval was desired for the whole piece of land or just the proposed parking facility. Mr. Gersten stated that the area between contour lines 262 and 248 would satisfy their immediate needs, but he could not promise that they would not come back to the commission at some time in the future. Mr. Gersten adjourned and the Commission discussed the application. Commissioner Paskiewicz stated that he is not too concerned about the brook on the property as it only has water when the rain comes off the highway. Commissioner Paskiewicz made a motion that in as much as the commission feels that the proposed Inl wrd Wetlands and Water Courses Commission ' September 7, 1976 Page 2 activity for this inland wetlands area would not constitute a significant impact on the area, that application be approved allowing the area between contour lines 262 and 218 to be used for parking purposes. Contour line 218 should be considered no farther east than 370 feet beginning at a pin in the northwest corner of the property on a line bearing north 85 degrees five minutes and zero seconds east. All work will be done with the approval of the r'ngineering Department of the Town of Berlin. Commissioner Lund seconded the motion. All in favor. Motion carried. The following items were then discussed: 1. Agent. Chairman Bensgton reported that Commissioner Paskiewicz indicated he would be willing to act as the Commission's Acting Agent until such time as Mr. Shannon's replacement is hired. Commissioner Lund suggested that other Commission members be called when property reviews are necessary so that those who could attend would be More knowledgeable„ as only so much can be learned from a picture. Commissioner Lund made a motion, seconded by Commissioner Niezalis, that Commissioner Paskiewicz be Acting Agent until such time as a Deputy Town Engineer is hired. All in favor. Motion carried. 2. Correspondance. Letter was received from the State Central Connecticut Regional Planning Agency requesting that the Commission report any areas of the town which they feel may be environmentally important or ecologically sensitive natural areas/habitats. (Letter attached). The following areas were discussed: The flats on Middletown Road, the Glenn property, the land surrounding the acquiftr.;•including the Bicentenial Park, the flat area up to Spruce Brook Road, the Kaminski property, the Cieniewicz property on Lower Lane, the land east of Stanley Chemical and Lamitation Mountain. A letter was also received from the State extending the permit issued to Roland Nadeau to May 25, 1977. 3. Vice Chairman. Commissioner Wiezalis suggested that the Commission consider a possible Charter Revision requesting that all boards and commissions be required to have a Vice Chairman. Chairman Bengston felt this requirement is fullfilled by having Commissioner Ripper as Secretary. 4 Minutes. Recording Secretary was requested to send copies of the minutes to Commissioner Bengston and Commissioner Ripper upon completion. 5. Letters of Decisions. Commissioner Wiezalis suggested that effective dates be typed on the top of outgoing letters in case of appeals. This would cover the Commission. Meeting adjourned at 9:05 p.m. .
