1979/03/06 .),411Wk March 6, 1979 Meeting of the Inland Wetlands & Water Courses Commission was called to order by Chairman Bengston at 7 : 30 P.M. at Town Hall. Those in attendance were: Commissioner Bourgoin, Commissioner Paskiewicz, Commissioner Harris, Commissioner Wiezalis, Mr. Richard Howard, Agent; Chairman Bengston. Approximately 10 people attended the Public Hearing portion of the meeting. The following items were discussed: 1. Boundary Change #79-4W. Public Hearing. Chairman Bengston stated the proposal. Commissioner Bourgoin read the legal notice. Mr. Howard told the reasons for the boundary change. He stated the area is obviously a wetlands and that soil scientists had examined the site and have determined it to be wetlands. He then described the location on the map. Residents in the area had questions about the limit of the wetlands and what classifying the parcel as wetlands means as far as road con- struction and development. Commissioner Wiezalis asked who owned the property. Mr. Howard stated Earl Wicklund, Inc. owned the majority of the property and Mr. Wicklund was sent a copy of the legal notice. There were no objections from the public. Public Hearing adjourned 8 : 00 P.M. Motion by Commissioner Bourgoin, second by Commissioner Harris to approve the boundary change as stated in the legal notice. The boundary change is to become effective the date of publication in the newspaper. All in favor. Motion carried. 2. Agenda Item 2. Discussion of the installation of a culvert in Willow Brook in violation of permit 76-1 by John E. Toffolon. Mr. Robert Little of Littles Auto Body, 133 New Britain Road was present and stated he notified the Town about this pipe because his shop is flooded because the pipe is too small to carry the flood water. He showed pictures of the pipe and surrounding area. Mr. Toffolon stated he didn' t feel the pipe on his property caused the flooding. After lengthy discussion it was the consensus of the Commission that the pipe was installed in violation of the wetlands regulations; that the pipe is too small since downstream culverts have much more capacity; that within seven days corrective action must be taken to prevent upstream flooding. The correcti action will consist of removing the pipe or constructing a bypass channel satisfactory to Commissioner Paskiewicz and Mr. Howard. The bypass channel must be constructed to prevent erosion. After the corrective action is taken a permit will be required for work previously done, corrective work and any future work in the brook. 3. Application 79-1WF. Application of Henry Maino to put an addition on Berlin Welding Co. , Inc. 1260 Farmington Ave. Mr. Maino explained his proposal and stated he would floodproof the addition and the existing building to the 100 year flood elevation. The addition will be approx- imately 200 feet from the river. Motion by Commissioner Paskiewicz, second by Commissioner Wiezalis to approve the application with the general conditions. All in favor. Motion carried. 4. Application 79-2WF. Application of Meadow Haven, Inc. for conceptual road layout approval of Summit Wood subdivision, Orchard Road. Mr. DeFrancE Mr. Dimmock and Mr. Prior presented plans of the overall layout. Mr. Sam Carabetta was also present. The roads and brook crossings will be in the same locations as the fire lanes approved by the Commission in application 76-2. The Commission felt that due to public interest a public hearing should be held. The Commission will try to arrange the public hearing on the same night the Planning Commission will hold their public hearing. Commissioner Wiezalis requested the plans be colored for purposes of clarity. The Commission members will arrange to view the site before the public hearing. 5. Application #79-3WF. Application of Meadow Haven, Inc. to construct roads, houses and drainage in Section I of Summit Wood, Orchard Road. Mr. DeFrances, Mr. Dimmock and Mr. Prior presented plans for Section I of the Summit Wood subdivision. Mr. Sam Carabetta was also present. Commissioner Wiezalis stated the plans should clearly show the limit of the wetlands on each lot. It was agreed upon by the applicant and the Commission that the application for Section I could not be officially accepted until after the public hearing for Application 79-2WF. 6. The minutes of December 5, 1979 were approved with corrections. 7. A letter to Mr. Howard from Dennis Blanchette of D.E.P. dated March 2 , 1979 regarding the disposal of chemical wastes at the Deming Road dump was read. Meeting adjourned at 11: 00 P.M.
