June 3 , 1980
A meeting of the Inland Wetlands and Water Courses Commission
was called to order by Chairman Bengston at 7:35 p.m. at Town
Hall. Those in attendance were : Chairman Bengston,
Commissioner Harris , Commissioner Paskiewicz , Commissioner
Wiezalis and Commissioner Dobek.
The following items were discussed :
1. Application 78-16WF. A continuation of an original
application dated November 27, 1978 by Family Realty,
Inc . , of New Britain Avenue , Plainville , to fill a clay
pit pond on Lot 3B, Block 76A, Christian Lane .
Mr. James Manafort, President of Family Realty , stated
that he purposes to fill the clay pit pond for use as
a future light, industrial park. Mr. Stanley Miarzekewski
accompanied Mr. Manafort and maps were presented showing
the proposed plan. Mr. Manafort pointed out that a
section of the pond would be left as a flood plain area.
Chairman Bengston stated that a public hearing would
have to be scheduled in view of the fact that this
application would definitely have a significant impact
on the wetlands . Commissioner Wiezalis felt that any
discussion on this application should wait until the
public hearing . Chairman Bengston suggested that Mr.
Manafort prepare a complete and comprehensive presentation
for the hearing . He also told Mr. Manafort that the
Environmental Review Team, who made a study of all the
clay pit ponds last August , would be asked to attend the
hearing . It was also stated that the property owners
directly affected by this application would be notified
of the public hearing.
Chairman Bengston said that he would contact the Environ-
mental Review Team to see if they would be available to
attend the hearing . A tentative date of July 9 , 1980
was scheduled for the hearing in the public meeting room
of the Town Hall. Commissioner Wiezalis made a motion to
accept Application 78-16WF and adjourn to a Public Hearing .
Seconded by Commissioner Harris . All in favor. Motion
carried .
2. Application 80-3. Application of Anthony Salerno of
110 ' oodspeed Avenue , Meriden, Connecticut , to fill a
part of the wetlands on Lot 20 , Block 53 , Wilbur Cross
Highway between the Red Cedars Motel and the Hawthorne

Inn, for the purpose of improving the property for future
commercial development. Mr. Salerno appeared before the
Commission accompanied by Mr. Rod Hewitt, Engineer.
Mr. Hewitt told the Commission that a watershed analysis
had been made and that the existing flow in a 25 year
storm is 38 cubic feet per second and that after the
property was filled and paved ; it would be 29 cubic feet
per second . A retention pond would be constructed and a
21 inch pipe added to handle the water flow. Mr. Salerno
said that he had not notified the property owner to the
north of this proposal , however, Mr. Hewitt stated that he
felt that the proposed plan would definitely improve the
situation for the owner on the north. Mr. Hewitt further
stated that approximately 60% to 70% of the wetlands :could
be filled with this proposal , which is approximately one
acre of the 3.7 acres owned by Mr. Salerno . Commissioner
Paskiewicz indicated that he was concerned as to whether
this portion of wetlands should be allowed to be filled .
After further discussion, Chairman Bengston told Mr. Salerno
that a public hearing would be required since this appli-
cation would cause a significant impact on the wetlands .
He also told Mr. Salerno that the property owner on the
north would be notified of the public hearing , as well as
the State of Connecticut .
After lengthy discussion, the Commission felt that in
accordance with Section 5.6 of the Inland '''etlands and
'':'ater Courses Regulations , a public hearing ' as required.
Commissioner Wiezalis made a motion to adjourn to public
hearing scheduled for July 1 , 1980 with appropriate
publication. Seconded by Commissioner Harris . All in
favor. Motion carried .
3 . A motion was made by Commissioner Harris to accept the
minutes of the March 4, 1980 meeting and was seconded by
Commissioner Wiezalis .
4. Chairman Bengston read a newspaper article dated April 29 ,
1980 to the Commission concerning a State Supreme Court
decision which stated that a lay commission must seek
expert advice in handling complex and technical matters .
5. Chairman Bengston informed the Commission that the Flood
Hazard Ordinance dated August 31, 1977 had been revised
and considerable more responsibility has been given to
this Commission. The revised ordinance has yet to be .
approved at a town meeting .
