Mr . Hewitt further stated that he felt that this
proposal is in compliance with what is recuired by the
Flood Plain Ordinance as read by Chairman B=ngston; i .e . ,
that there would not be any significant difference in the
flood levels . He also stated that he felt that the con-
struction of a building in the floodway would not have any
adverse effect on the property on either side of the brook.
It was stated for the record that the maps presented
tonight had been revised from the February 3 , 1981 meeting
to take in account contours and , also, that the floodway
line had been removed .
Attorney Argazzi told the Commission that he had
contacted the Army Corps of Engineers and sent them a copy
of a map.
The Commission discussed at length the letter submitted
by Mr. Hewitt. There was some doubt as to whether this
letter would qualify as proper certification which is
clearly recuired by the Flood Plain Ordinance - Section IV,
15 (a) . Commissioner Paskiewicz felt that if this letter
was accepted by the Commission, it would set a precedent
for future applications where certification is required .
He suggested that it might be desirable to seek the advice
of Attorney Jackaway , Town Counsel . Commissioner Pentore
also felt that the Commission should ask Attorney Jackaway
for his opinion. Commissioner Dobeck felt that the letter
was satisfactory and that the Commission should vote on
the application at this meeting. After further discussion
and review of the Flood Plain Ordinance , Commissioner
Wiezalis drafted a proposed letter to Attorney Jackaway.
Commissioner Paskiewicz made a motion to tacle the applic-
ation pending an opinion from Attorney Jackaway. Seconded
by Commissioner- Pentore . Four in favor - one opposed (Com-
missioner Dobeck) . Motion carried .
2. Application 81-3F. Application of New Britain Bank and
Trust Company for a proposed building on Lot lx, Block 83BB,
Webster Square Road . The property is presently owned by
Mr. George A . Closson and an "Agreement of Sale" was pre-
sented to the Commission. Mr. Mark Roming of Foming
Associates represented the Bank. Mr . Roming explained
that the Bank proposes to fill 2000 cubic Yards , including
paving , in a flood hazard zone in order to construct a
building . They propose to fill six inches above the 45 '
flood elevation and then drop the grade off quickly. The
Commission did not see any problem with this application.
Commissioner Wiezalis made a motion to approve the applica-
tion with the general conditions . Commissioner Pentore
seconded the motion. All in favor. Motion carried .
3. A motion was made by Commissioner Dobeck to accept the
minutes of the February 3 , 1981 meeting and seconded by
