Those in attendance were : Chairman Dobeck, Commissioner Gombotz , Commissioner Murphy, Commissioner Phaneuf, Commissioner Sataline , Commissioner Selner, Commissioner Szczepanik and Mr. Joseph Paskiewicz , Agent for the Commission. The following items were discussed : 1 . Application 85-19W. Application by Meadow Haven, Inc . , to in- stall culvert at stream crossings on Lot 21 , Block 74, located south of cul-de-sac at the end of Mohawk Drive . Mr. Sam Carabetta , President of Meadow Haven, attended the meeting accompanied by Mr. Rod Hewitt, Engineer. It was noted for the record that a letter has been submitted from Olga Lechowicz , owner of the property , giving Meadow Haven permission to come before this Commission. Mr . Hewitt presented a map and stated that they propose to install three culverts under proposed roads to provide access into interior portions of the property . The locations of the proposed culverts were indicated on the map. Mr . Hewitt stated that the purpose of the culverts would be to pass water from an intermittent stream which takes water from the watershed . Mr. Hewitt further stated that these areas are not in the flood hazard zone in accordance with the Flood Study Map nor are they depicted as wetlands . He stated that they propose to install 24" culverts subject to possibly going larger when development plans are completed . Mr. Paskiewicz stated that he felt that this stream is a significant water course because it drains the mountainside . He inquired as to whether the Army Corps of Engineers had been contacted to see if they have any jurisdiction. Mr. Hewitt was going to check to see if his staff had contacted the Corps . Mr. Paskiewicz also noted that Mr. Morgan Seelye , Town Engineer, indicated that the size of the pipe must be in accordance with a 25 year storm when the area is developed . The Commission discussed this application at length. Commissioner Selner made a motion to approve Application 85-19W, excluding Note #2 , as shown on the map entitled "Meadow Haven, Inc . Application - Proposed Stream Crossings for Lot 21 - Block 74 - Orchard Road , Berlin , Conn. , Hewitt Engineering P .C . Date : Oct . 23 , 1985 - scale : as shown - sheet No . 1 of 1 - Project No . 85190" with the following conditions : 1) Pipes are to be temporary in nature - to be used for construction - 2 - purposes . Permanent pipe size shall be determined at a later date and sized for a 25 year storm and shall be subject to approval by the Town Engineer. 2) All proper sedimentation controls shall be installed before construction begins and as indicated on the submitted map. 3) Approval of this applica- tion is based on the circled areas of the map only. Motion seconded by Commissioner Phaneuf . All in favor. Motion carried . 2 . Application 85-20WF. Application by Mr. Mark Balavender to fill a wetlands and flood hazard area on Lot 23 , Block 84, located on Farmington Avenue *1000 feet southeast of Porters Pass Inter- section. Mr. Balavender, owner of the property , attended the meeting accompanied by Mr. Rod Hewitt , Engineer. Mr. Hewitt presented a map and stated that this property is located on the north side of Farmington Avenue next to Frank's Appliance . He stated that Mr. Balavender desires to relocate his nursery business in the rear of the property and to improve the land- scaping of the front area for some possible future use . He further stated that they propose to extend the drainage , which terminated in the unfilled areas during previous filling, into the balance of the pond and to fill up to the property line . The filling would be at the same elevation as the filling in the front of the property . Mr. Balavender stated that he pro- poses to topsoil and seed the front area for the present which would greatly improve the appearance . Mr. Hewitt stated that the filling of the pond would have no effect on flooding . It was noted that this property had come before this Com- mission several years ago by a previous owner and at that time permission had been given to fill 200 ' . The Commission review- ed the minutes of July 6, 1978 involving the original applica- tion. Commissioner Sataline made a motion to approve Application 85-20WF as shown on the map entitled "Mark A. Balavender Applica- tion - Proposed. Site Grading Filling for Lot 23 , Block 84, Farmington Ave . , Berlin, Conn. , Hewitt Engineering P .C . , Date : Oct. 23 , 1985 - scale : 1" = 40 ' - Sheet No . 1 of 1, Project No. 85161" with the following conditions : 1) Only clean fill shall be used ; 2) Pipe sizes to be approved by the Town Engineer and 3) Proper sedimentation controls to be applied if needed in the opinion of the Town Engineer or Wetlands Agent . Seconded by Commissioner Murphy. Five in favor, one opposed (Commissioner Selner),, one abstention (Commissioner Phaneuf) . Motion carried . 3 . The minutes of the October 1 , 1985 meeting were approved with the following correction: page 2, first paragraph - correct Condition #2 to read as follows : 2) Sedimentation controls shall be put into place before any construction is done in the area requiring sedimentation controls .
