1985/05/07 O �O r= c TOWN OF BERLIN INLAND WETLANDS AND WATER COURSES COMMISSION ac ;41:2 1' 5 ,�qh TOWN HALL • BERLIN, CONN. 06037 ORpORAZE9 May 7, 1985 A meeting of the Inland Wetlands and Water Courses Commission was called to order by Chairman Dobeck at 7:40 p.m. in Room 6 of the Town Hall . Those in attendance were : Chairman Dobeck, Commissioner Gombotz , Commissioner Selner, Commissioner Szczepanik and Mr. Joseph Paskiewicz , Agent for the Commission. The following items were discussed : 1. Application 85-9W. Application by Sherwood Industries to fill a portion of a clay pit pond on Lot 84 and Lot 84F, Block 76, located north of Berlin Steel on Depot Road . Mr. George Catrambone of Catrambone Development Corp. , construction managers and developers of the project for Sherwood Industries , Mr. Steven Selger, Site Planner from L.A .D .A. , and Mr. Fred Hornaday , representing Sherwood Industries , attended the meet- . ing. It was noted for the record that a letter of consent for Lot 84F was received from Alpio and Cotardo Giulietti , owners of the property. A detailed map was presented and Mr. Catram- bone stated that the total acreage involved for this project is approximately 15i acres - 6 acres presently owned by Giulietti and 9 acres owned by Sherwood Industries . He pointed out on the map a small existing clay pit pond and a larger pond that goes out as far as Route 72. They propose to extend drainage from the facility into the pond area as well as place approxi- mately 3000 cubic yards of material into the pond . It was noted that the depth of the pond is 13 ' in the center. Mr. Catrambone explained the proposed drainage plan and noted that there are two reasons for connecting the two ponds : 1) to cleanse the area which is very dirty at the present time and 2) to drop the elevation to allow construction of the drainage structure . He stated that the scope of work involved consists of filling area, cleaning shoreline area and discharging roof drainage and storm sewer system into the pond which would act as a retention area. Mr. Selger stated that they propose to repair and upgrade the area which would offer an attractive visual appearance . He further stated that during construction a silt fence would be installed to trap all silt and would re- main until the area was seeded and erosion possibilities were down to bare minimum to nonexistent . Hay bales would also be placed where necessary. Commissioner Gombotz made a motion to accept Application 85-9W as shown on the map entitled "Sherri Cup Inc . , Berlin, Ct . , Project No. 92 - L-1 , L-2 , L-3 , L-4 , L-5 , L-6 - Scale : 1" = 40 ' -0" - Date : April 24, 1985 ." Proper sedimentation controls I - 2 - are to be applied if needed in the opinion of the Town Engineer or Wetlands Agent . Seconded by Commissioner Szczepanik. All in favor. Motion carried . 2. Application 85-10WF. Application by The Connecticut Light and Power Company to do work on power lines in a wetlands and flood hazard area located east of Beckley Road and Savage Hill Road from East Berlin Substation on Beckley Road to the Middletown line on Spruce Brook Road . Mr. Irving Wilson, Superintendent of Operations - CL&P, and Mr. John Gladke , Distribution Engi- neering Supervisor, attended the meeting. Mr. Wilson stated that they propose to build a double circuit line from the East Berlin Substation southerly to the Middletown line and beyond . There is now a 115 kv pole line on the right-of-way and there is room for an additional 115 kv pole line . Plans were present- ed which indicated the proposed construction in the areas of the wetlands . Mr. Wilson stated that they propose to build roads , if necessary , and construct facilities . He further stated that they do not foresee any problems in this area and have done similar work throughout the state and Massachusetts . The work would consist of trimming, road building , digging pole holes , the setting of poles and the stringing of wire . Once this work is completed , Mr. Wilson stated that they do not presume to be on this right-of-way except for emergency conditions and inspec- tions . The area would be restored to its original state . He ' noted that any roads constructed would not be blacktop but would remain for maintenance purposes . Mr. Wilson stated that they would abide by any requirements or restrictions requested by this Commission and added that they are most anxious to begin work this summer if approval is granted . Commissioner Selner made a motion to accept Application 85- lOWF as presented on the map entitled "Survey Plan for Middle- town - Berlin Right-of-Way , Scale : 1" = 100 ' - Date : Sept, 1983 , No . 50787 - Sheet 8, 9 and 10 ." Proper sedimentation controls are to be app].ied where necessary . Seconded by Commissioner Szczepanik. Three in favor - one abstention (Commissioner Gombotz) . Motion carried . 3 . Application 85-11W. Application by Ann D. and Esther A. Farr to fill a wetlands area for a subdivision on Lot 5 , Block 12, located on the west side of Chamberlain Highway from West Lane south. Mr. Raymond Lugli , Professional Engineer of Harry E. Cole & Son, attended the meeting . It was noted for the record that a letter from Mr. Steven DeConti , owner of the property, has been placed in the file giving permission to Ann and Esther Farr to come before this Commission. Mr. Lugli stated that they propose to fill along the Chamberlain Highway, south of West Lane , in order to construct six houses . He noted that zoning regulations require that a thirty foot area be provided to the rear of each house for a backyard . They propose to grade this area out to the back and then slope into the existing grade. Mr. Frank E. Indorf, Soil and Environmental Consultant , also attended the meeting and his resume was handed out to mem- bers of the Commission. Mr. Indorf located the wetlands in the - 3 - field and they are indicated on the map presented . He described the various soils that have been flagged on the property . Mr. Lugli stated that they propose to fill a small area in the wetlands . The depth of fill would be approximately two to three feet in order to meet the zoning requirement. Detailed sedimentation and erosion plans are proposed to protect the wet- lands located further back on the property and are noted on the map presented . Mr. Lugli further stated that it is indicated on the map that the responsibility for implementing this erosion and sediment control plan is on the proposed developer. He noted that the increase in runoff into the wetlands from the site would be nominal and would result in no impact on the adjacent water course . Commissioner Gombotz made a motion to accept Application 85-11W as shown on map entitled "Plan Prepared for Ann D . Farr and Esther A . Farr, Berlin, Conn. , April 23 , 1985 - Scale : 1" = 40 ' - Harry E. Cole & Son , Civil Engineer & Land Surveyors - PH58," allowing filling not to exceed 40 cubic yards as shown on said map with the stipulation that each lot deed and lot map show the location of the Inland Wetlands line . No fill will be allowed westerly of the Inland Wetlands line as shown on the lot map. Proper sedimentation controls to be applied if needed in the opinion of the Town Engineer or Wetlands Agent . Seconded - by Commissioner Szczepanik. All in favor. Motion carried . 4. The minutes of April 2, 1985 were approved as presented . 5 . The Commission discussed a letter dated April 17, 1985 from Attorney James Ripper to Chairman Dobeck in regard to violations of the Inland Wetlands regulations on the Labickas property on Middletown Road . A letter will be sent to Attorney Ripper stat- ing that the Commission is currently investigating the legality of a letter from the DEP given to Mr. Labickas prior to the es- tablishment of this Commission in regard to filling on his pro- perty . 6. Mr. Paskiewicz requested an additional 450 .00 for Account 2351 needed as a result of increased advertising fees and the pur- chase of envelopes . 7. The Commission discussed a concern that Mr. Gregory Abrahamian, Executive Director of the Mattabassett District , had in regard to Skinner Valve dumping metals in the water off of Edgewood Avenue . Mr. Paskiewicz stated that he contacted Mr. James Pease of Skinner Valve and received a letter from him stating that all requirements of the DEP are being met . 8 . Mr. Ralph Simeone has not completed the removal of fill from the wetlands on Orchard Road as of yet , however, expects to have it taken care of shortly . When the work is completed , Mr. Paskiewicz will send a letter to the DEP informing them. 9 . The Commission discussed a letter sent to Mr. Thomas J. Lepore , - 4 - developer of the duplex houses on Burnham Street, from Mr. Morgan Seelye , Town Engineer, in regard to floor elevations of two houses located outside of the flood hazard zone . It was the consensus that this Commission has no jurisdiction over floor elevations outside the flood hazard zone . 10. Mr. Paskiewicz informed the Commission about a problem between two neighbors on Reservoir Road in regard to filling which they are both doing . Mrs . Perzanowski called the DEP and Mr. Recano was ordered to cover and clean up the area involved . Mr. Paskiewicz spoke to both Mr. Recano and Mr. Perzanowski and will send a letter stating that any future filling would require a permit from this Commission .
