A meeting of the Inland Wetlands and Water Courses Commission was
called to order by Chairman Selner at 7 : 34 p .m. in Room 6 of the
Town Hall . This meeting was reconvened from the May 6 , 1986 meeting .
Those in attendance were: Chairman Selner , Commissioner Gombotz ,
Commissioner Murphy , Commissioner Phaneuf , Commissioner Palasek,
Commissioner Szczepanik, Commissioner Zbrosek and Mr . Joseph
Paskiewicz , Agent for the Commission.
The following items were discussed :
1 . Application 86-9W. Application by Arthur Urban to fill a wet-
lands area on Lot 81A and 89 , Block 10 , located on the west side
of Chamberlain Highway , 200 '± southwest of Harvest Hill Road .
The Commission discussed at length the drainage situation in
this area and the impact that this proposal may have on this wet-
lands . It was their consensus that the map presented lacked
sufficient detail . It was also noted that the map was not certi-
fied by a professional engineer . The Commission felt that this
was a significant wetlands and felt that additional information
would be required as to hydrology , drainage, soils , amount of fill
and a more accurate detailed map .
Commissioner Zbrosek made a motion to deny without prejudice
Application 86-9W. Seconded by Commissioner Szczepanik. All in
favor. Motion carried .
The Commission stated their concern with the crossing of the
bog area , the area of South Slope Drive and the detention basins .
They also noted their concern with the following lots as shown on
the map presented : Lots 6 , 7 - Lots 8 , 9 , 10 in regard to limits
of fill - Lots 15 , 16 , 17 , 19 , 20, 22 , 23 , 27 and perhaps Lots
21 and 24 .
2 . Application 86-4W. Application by Carabetta Enterprises to fill
a wetlands area on Lots 25 and 28 , Block 153 , located on the east
side of Wilbur Cross Highway , south of #2447 . The Commission dis-
cussed the accuracy of the map in regard to the wetland area as
well as reviewed the letter from the DEP . Chairman Selner stated
that he was concerned about whether water retention for Silver
Lake would be endangered .
Commissioner Phaneuf made a motion to approve Application
86-4W based on raod crossings only . Any further work done with-
out additional approval by this Commission in the wetlands ,
drainage areas or water courses shall make this permit nil and

void . However , a permit will not be issued until a certified
map is received and reviewed by this Commission . Seconded by
Commissioner Gombotz . Five in favor - one abstention (Commission-
er Zbrosek) Motion carried .
Chairman Selner stated that he felt that it is a poor pre-
cedent to accept an application prior to accurate wetlands mapping .
3 . Application 86-8WF . Application by Nadeau Brothers to build a
building in a floodway on Lot Z20, Block 91 , located on the south-
east side of Washington Avenue , 600'± southwest of Farmington
Avenue . It was noted that this application was tabled at the
last meeting due to inaccurate mapping . The Commission discussed
the importance of the floodway .
Commissioner Murphy made a motion to deny Application 86-8WF .
Seconded by Commissioner Zbrosek. Five in favor - one opposed
(Commissioner Phaneuf) . Motion denied . It was the consensus of
the Commission that this application involved the floodway and
would create a significant hazard .
4 . Application 86-10WF . Application by Joseph Tricka to place fill
and appurtenances in a wetlands and flood hazard area on Lot 15 ,
Block 17 , located on the west side of Chamberlain Highway , 400 '±
south of Old Hatchery Road . The Commission felt that this applica-
tion would have a minimum impact on the wetlands in that it only
involves crossings and a small amount of fill on one lot for pro-
per depth .
Commissioner Szczepanik made a motion to approve Application
86-10WF as shown on the map entitled "Heritage Associates - MBA
Engineering , Job #86024 , sheet 1 of 1 , scale : 1" = 100 ' - Date :
April 29 , 1986 . " All in favor . Motion carried . Proper sedimenta-
tion controls to be installed prior to construction and in accor-
dance with the Town Engineer or Wetlands Agent .
5 . Application 86-11W. Application by New England Building and
Development Institute to place and remove material in a wetlands
area on Lots 6 and 8 , Block 144 , located on the west side of Main
Street , 200'± and 500 '± south of Route 72 . Mr . Kavarsky attended
the meeting in case the Commission had any questions and explained
that he was unable to attend the May 6th meeting .
Commissioner Palasek made a motion to approve Application
86-11W as shown on the map entitled "New England Building and
Development Institute - Lots 6 , 8 and 29 , Main Street , East
Berlin - Hewitt Engineering, Project #85166 , sheet 1 of 1 , scale :
1" = 100 ' - Date : 3/19/86 . " Proper sedimentation controls to be
installed along encroachment line before construction begins and
hay bales should be placed on the south side . Seconded by Com-
missioner Szczepanik. All in favor. Motion carried .
6 . Application 86-12W. Application by Kenneth Nelson to place fill
in a wetlands area on Lot 1A, Block 140, located on Bishops Curve
and Wilbur Cross Highway . The Commission discussed the pond and

what effect , if any, this proposal may have downstream.
Commissioner Murphy made a motion to approve Application 86-
12W as shown on the map entitled "Kenson Co . , Lot 1-A-Block 141 ,
Bishops Curve, Berlin , Ct . , Hewitt Engineering - Project #85129 -
sheet 1 of 1 - scale : 1" = 20 ' - Date : 3/9/86 - revised : 5/6/86"
with the following conditions : 1) Adequate bonding to insure that
th'e job is done correctly ; 2) Sedimentation controls to be install-
ed prior to construction and in accordance with the Town Engineer
or Wetlands Agent and 3) Filling should be in accordance with the
map . Seconded by Commissioner Phaneuf . All in favor . Motion
carried . It was noted for the record that comments were accepted
from interested persons at the May 6th meeting .
7 . Application 86-13WF . Application by Rowland , Inc . , to construct
an industrial road and industrial complex in a wetlands and flood
hazard area on Lots 7 and 8 , Block 127 , located on the west side
of Wethersfield Road , south of the Sebethe River . Commissioner
Gombotz made a motion to approve Application 86-13WF as shown on
the map entitled "Flood Hazard Map - Proposed Site Development -
Lots 7 and 8 , Block 127 , Wethersfield Road , Berlin , Ct . , MBA Engi-
neering , Job #86090 - sheet 1 of 1 - scale: 1" = 100 ' - Date :
4/25/86 . " Sedimentation controls are to be installed prior to
construction and in accordance with the Town Engineer or Wetlands
Agent . Hay bales are to be placed all along the floodway line on
north side of the project . There is to be no development in the
floodway . Seconded by Commissioner Palasek. All in favor . Motion
carried .
8 . Application 86-14WF . Application by Ralph Simeone to fill a wet-
, lands and flood hazard area on proposed Lots 2KK and 2LL , Block 118 ,
located at the intersection of Elizabeth Road and Ralph Drive , Cedar
Acres subdivision off Orchard Road. It was noted that a letter was
received from the DEP in regard to a sewer line that is creating a
damming effect . Mr. Simeone is in the process of correcting this
situation.
Commissioner Szczepanik made a motion to approve Application
86-14WF as shown on the map entitled "Cedar Acres - Ralph J .
Simeone, Developer - Ralph Drive and Elizabeth Road , Berlin , Ct . ,
MBA Engineering - Job #85003 , sheet 1 of 1 , scale : 1" = 40 ' -
Date : 4/29/86" with the following conditions : 1) Proper sedimenta-
tion controls to be installed prior to construction and in accor-
dance with the Town Engineer or Wetlands Agent and 2) Fill not to
extend beyond limits indicated on the map . Seconded by Commissioner
Murphy . All in favor. Motion carried .
9 . Application 86-15WF . Application by KS Partnership to improve an
existing driveway in a wetlands and flood hazard area on Lot 15A ,
Block 15 , located on the west side of Chamberlain Highway , north
of #1606 . Commissioner Gombotz made a motion to approve Applica-
tion 86-15WF as shown on the map entitled "Preliminary Sketch Lay-
out - K. S . Partnership - Lot 15A, Block 15 , Chamberlain Highway -
MBA Engineering - Job #86073 - sheet 1 of 1 - scale : 1" = 80 ' -
Date : 4/21/86" with proper sedimentation controls to be installed
prior to construction. Seconded by Commissioner Zbrosek. All in

11 . Application 86-17W. Application by Henry Budney to make alterations
in a wetlands area on Lot 7F , Block 153 , located on the north side
of New Park Drive - 918 '+ east of the Wilbur Cross Highway . Com-
missioner Murphy made a motion to approve Application 86-17W as
shown on the map entitled "Erosion and Sediment Control Plan - Pre-
pared for Budney Company , Inc . , 40 New Park Drive, Berlin , Ct . -
Torres Engineering , Inc . , sheet 2 of 3 - scale : 1" = 40' - Date :
May 6 , 1986 . " Proper sedimentation to be applied as shown on the
map . Seconded by Commissioner Phaneuf . All in favor . Motion
carried .
12 . Application 86-18W. Application by the Town of Berlin Water Control
Commission to install a culvert across existing intermittent water
course on Lot 29 , Block 153 , located on the east side of Wilbur
Cross Highway , north of #2447 . Commissioner Phaneuf made a motion
to approve Application 86-18W as shown on the map entitled "Water
System Improvements - Tank Site Access Road - Contract WS85-02-C -
Hewitt Engineering - sheet 6 of 6 - Date : 12/6/85 . " Proper sedi-
mentation controls to be installed prior to construction . Seconded
by Commissioner Palasek. All in favor . Motion carried .
13 . The minutes of April 1 , 1986 and April 3 , 1986 were approved as
presented .
14 . Chairman Selner stated that an enforcement agent for the DEP would
like to meet with this Commission at a date to be arranged .
15 . A letter will be sent to the Planning Commission from the Wetlands
Commission stating concern about Mr . Ciammella developing further
into the area off Four Rod Road before properly finishing the
conditions that were required by this Commission and recommend
that no permit be issued until work is completed .
16 . Mr . Paskiewicz informed the Commission that he had received com-
plaints about filling being done on Beckley Mills Road . He checked
out the situation and found that the lot did indeed look like a
landfill . A letter will be sent stating that their permit is nil
and void and the area must be cleaned .
17 . Commissioner Phaneuf inquired as to filling taking place on pro-
perty on Middletown Road and dumping behind Mars Department Store .
Mr . Paskiewicz stated that he would check it out .
