BERLIN, CT 06037 9RAlVO November 14, 1989 The November 14, 1989 meeting of the Inland Wetlands and Water Courses Commission was called to order at 7 p.m. in the Meeting Room of the Town Hall. Those in attendance weres Commissioner McCarthy, Commissioner Munson, Commissioner Murdoch, Commissioner Murphy, Chairman Selner and Mr. Morgan Seelye , Town Engineer. Acceptance of Minutes Commissioner Murdoch moved to accept the October 3, 1989 minutes as submitted. Seconded by Chairman Selner. (One Abstaintion - Commissioner McCarthy) . All in Favor - Motion Carried. New Business to Come Properly Before the Commission There was no new business presented at this time. REGULAR MEETING 1 . Application 89-33F. Proposal by Matanto, Dalchio and Volstein to place fill in a flood hazard area on Lot 24, Block 84, Farmington Avenue . Bart Bovee represented the applicant and submitted a revised plan reflecting changes made for the Planning & Zoning Commission in regard to the site location and surface area surronding the building. The property is Frank's Appliance and it will be con- verted into a retail office plaza. The applicants would like to place 520 cubic yards of material within the parking area to allow for proper storm drainage (ie. , catch basins and piping) and grading to be done. Mr. Bovee explained the current drainage problem that exists and the applicants will not be able to meet the required "zero" impact. Chairman Selner moved for a Summary Ruling. Seconded by Commissioner Murphy. Chairman Selner stated that the impact to the flood hazard zone is there but negligible . All in Favor of the Summary Ruling - Motion Carried. - 2 - Commissioner P,urdoch motioned to approve Application 89-33F as shown on the plans entitled "Site Plan IV; Proposed Retail Office Plaza; Redcoat Square, 1089 Farmington Avenue Plaza, Berlin CT; Property Known as Lot 24, Block 84; MBA Engineering; Job No. 89-109; Sheet 1 of 2; Scale: 1" = 20 ' ; Date: November 2, 1989" with all erosion and sedimentation control devices to be installed to the satisfaction of the Town Engineer prior to the commencement of construction. This is not to be misconstrued as a precedent for extenuating circumstances of "zero" impact . Commissioner Munson seconded the motion. Chairman Selner moved that an alternative storm and sewer discharge system be installed as seen on the map to the satisfaction of Town Staff. Commissioner Munson seconded the motion. All in Favor of the amendment - Motion Carried. All in Favor of Application 89-33F. Motion Carried. 2 . Application 89-34F . Proposal by }rank and James Manafort to install a sanitary sewer beneath the Matta- bassett River on Lot 13, Block 12, Chamberlain Highway. Bart Bovee submitted a letter to the Commission regarding an amendment to the original application. The coverage on the pipe is the only difference -- the coverage was originally 24" and the coverage will now be 18" . A proposed sanitary utility crossing the Mattabassett River for a four-lot sub-division. There will be no additional fill placed and surronding areas will be restored to their original state. Mr. Seelye stated the applicant will need a letter of approval from the City of New Britain Board of Water Commissioners. Mr. Bovee stated they should be able to get the letter of approval by the next Inland Wetlands Commission Meeting on December 5, 1989. Chairman Selner moved to table Application 89-34F until all proper documentation has been received from the applicant. Commissioner Murdoch seconded the Motion. All in Favor - Motion Carried. 3. Other Business to Come Properly Before the Commission a) Application 89-09W - R&S Associates - Declaration of Restrictions. - 3 - Debra Dorio of Kotchen and Ripper went over the Declaration of Restrictions with the Commission. Owners of Lot 14-48 and Lot 14-10 will have to come before the Commission due to encroachment lines at the present time. Restrictions will be for Phase I only at this time and restrictions will be placed later on the deeds in the other phases of the project. Chairman Selner moved that the Declaration of Restrictions be accepted as presented. Commissioner Murdoch seconded the motion. All in Favor - Motion Carried. A copy of the Declaration of Restrictions will be on file at Town Hall. b) Illegal Encroachments - Lot 6, Block 138 - Middle- town Road. Some "dressing" has been place on the property per Mr. Labacus (the property owner) . A letter from David Emerson, Department of Environ- mental Protection, dated February 14, 1975 was presented to the Commission. The letter stated that agricultural use of the wetlands is allowed (growing crops and raising animals) . The letter also stated what should not be done on property that contained wetlands. The Commission stated that a plan will have to be submitted stating what has been done and what will be done to the property. The Commission will need to receive the plan within 60 days. Chairman Selner will do a site visit to the property on Saturday, November 18 , 1989 at 9 a.m. c) Correspondence Berlin Motor Inn - A representative was not present. The owner has had some financial problems. Staff is willing to work with the owner as some work must be done within the next month or some legal action will be taken. Chairman Selner moved to empower staff to work with the applicant to show progress on the property within the next 30 days or legal action will be taken. Commissioner Munson seconded the motion. All in Favor - Motion Carried. Berlin Welding - Some fill is being done behind the company. A berm is being bult and staff is looking into the situation. Richard Machine - Staff has talked with Attorney Sullivan regarding this application. Chairman Selner stated he would like to have the new regulations in place for Earth Day, April, 1990. Regarding the letter received from the Town of Newington - the Town of Newington would like to establish a berm for flood storage purposed on Raleigh Street.
