BERLIN, CT 06037 `° o `� December 1, 1992 ORATE The regular meeting of the Inland Wetlands and Water Courses Commission was called to order at 7:04 p.m. by Chairman McCarthy. PRESENT - Commissioner Balinskas; Commissioner Colburn; Commissioner Collis; Commissioner Daigle; Commissioner Ferraro; Chairman McCarthy; Commissioner Szczepanik and Mr. James Horbal, Agent for the Commission. ACCEPTANCE OF MINUTES - MEETING OF NOVEMBER 10, 1992 Moved by Commissioner Collis and Seconded by Commissioner Ferraro to accept the November 10, 1992 minutes as amended on Page 8, the last Paragraph "memo" was misspelled. Commissioner Balinskas - yes; Commissioner Colburn - yes; Commissioner Collis - yes; Commissioner Daigle - yes; Commissioner Ferraro - yes; Chairman McCarthy - yes; Commissioner Szczepanik - abstain. All in Favor - Motion Carried. AUDIENCE OF CITIZENS There was no participation at this time. REGULAR MEETING 1. Application 92-27WF - Proposal by Algonquin Gas Transmission Company to install a 36" gas line through a wetlands and flood plain area south of Orchard road between Patrick Drive and the Chamberlain Highway. Commissioner Colburn did not participate in the discussion. The applicant is proposing construction of a 1.9 mile 36" high pressure gas transmission line through private lands running south of Orchard Road from the AMTRAK line just west of Patrick Drive to a metering station opposite the South Kensington Fire Department on the Chamberlain Highway. The proposed line will parallel existing 30" and 26" mains running through this area. Installation of this line will require several stream crossings along the route. This request is similar to one that was recently approved to provide for installation of the same 36" line from the AMTRAK line eastward into Middletown. At the public hearing, the State of - 2 - Connecticut expressed concern over the possible disruption of a gravel packed well on the grounds of the Salmon Hatchery off Old Hatchery Road. Chairman McCarthy stated that during the Public Hearing, an individual from DEP-Fisheries made reference to a well. What is the status of the meeting between Algonquin and DEP? Mr. Harney of Algonquin stated Algonquin has hired a hydrologist to study the pipeline impacts on the well. Algonquin does not anticipate any impacts to Well #1. If changes need to be made to the pipeline due to impacts on the well, then Algonquin would come back before the Commission. Algonquin will come to an agreement with DEP. The pipeline can not continue over this area until DEP has given approval, as DEP is the property owner. Moved by Chairman McCarthy and Seconded by Commissioner Balinskas to approve Application 92-27WF as shown on the plans entitled "1.9 Mile Pipeline Loop, Berlin, CT, Proposed 36" Pipeline Route; Conklin and Soroka, Inc. , Consulting Engineers, Cheshire, CT; Algonquin Gas Transmission Co. , Boston, MA; Scale 1" = 50 ' ; Project No. 1112 . 1; Date: 9/15/92; Sheet 1 of 7 and 6 of 7 ; 1. 9 Mile Pipeline Loop, Berlin, CT, Proposed 36" Pipeline Route through Wetland No. 1 and 2; Sheet 2 of 7; 1. 9 Mile Pipeline Loop, Berlin, CT, Proposed 36" Pipeline Route through Wetland No 3 and No 4; Date: 9/16/92 ; Sheet 3 of 7; 1.9 Mile Pipeline Loop, Berlin CT Proposed 36" Pipeline Route through Wetland No 4 and 5; Date: 9/21/92; Sheet 4 of 7; 1.9 Mile Pipeline Loop, Berlin CT Proposed 36" Pipeline Route Crossing through Wetland No. 6; Date: 9/21/92 ; Sheet 5 of 7; 1.9 Mile Pipeline Loop, Berlin, CT, Proposed 36" Pipeline Route Crossing Wetland No 7 and No 8; Date: 9/21/92 ; Sheet 7 of 7" with all erosion and sedimentation control devices to be installed to the satisfaction of the Town Engineer prior to the commencement of construction. The applicant notify the Town Engineer before construction is started. Weekly reports be submitted to staff from an environmental specialist hired by Algonquin Gas. The construction schedule be July 1, 1993 to October 31, 1993 . All in Favor - Motion Carried. Commissioner Colburn returned to the discussion at this time. 2. Application 92-28W - Proposal by Howard Asal/Asal Realty to place fill in a wetland area on Lot 24-3, Block 133, Dogwood Lane. The applicant is requesting permission to fill a triangular piece of wetlands previously established under Section I of the Westview Acres Subdivision (86-21W) which is located off - 3 - the north side of Berlin Street approximately 300 feet west of the intersection of Wilcox Avenue and Berlin Street. The applicant is requesting this permit due to the poor marketability of the lot. A letter was recevied by the Commission from Howard Asal requesting the Commission to table any action on the application at the meeting. Moved by Commissioner Ferraro and Seconded by Commissioner Colburn to table Application 92-28W until the January, 1993 meeting. All in Favor - Motion Carried. OTHER BUSINESS TO COME PROPERLY BEFORE THE COMMISSION a. Correspondence The Commission received a letter of intervention in regard to the Fox Hill Subdivion from Clyde Selner. The Commission determined that Staff should return the letter of intervention to Mr. Selner as there is no application before the Commission on the Fox Hill Subdivision. b. 1993/94 Budget Moved by Commissioner Collis and Seconded by Commissioner Szczepanik to accept the 1993/94 Budget as proposed by Staff. All in Favor - Motion Carried. c. Lot 58B Jeffrey Lane - Discussion Mr. Pollock who is the potential owner of Lot 58B, Jeffrey Lane appeared before the Commission. Mr. Horbal updated the Commission on the application. The project originally came before the Commission in 1986 or 1987 with approximately 26 lots. Mr. Horbal stated there are wetland restrictions and flood plain elevations on the lots. Mr. Pollock stated that in the front area of the property he would like to establish a pond so the house can be viewed from the street. The side of the house would be fine the way it is for a yard. Mr. Horbal stated that if a pond was constructed it would need to be constructed in such a way to allow water to flow through the area. - 4 - Commissioner Ferraro stated that in concept that it is feasible. Mr. Pollock stated he would like the pond but with as minimal depth as possible so there would be no problems with children in a residential neighborhood. Chairman McCarthy asked if it was an approved building lot. Mr. Horbal stated that it is an approved buidling lot. Commissioner Colburn stated that he is concerned about the construction of the pond as it is in a seasonal water course. It would be more desirable to have minimal clearing of the property and plantings placed in the area.
