BERLIN, CT 06037 pRA1EO. February 1, 1994 The regular meeting of the Inland Wetlands and Water Courses Commission was called to order at 7: 05 p.m. by Vice-Chairman Ferraro. PRESENT - Commissioner Argazzi; Commissioner Balinskas; Commissioner Colburn; Commissioner Collis; Commissioner Daigle; Commissioner Ferraro STAFF - Mr. James Horbal, Agent for the Commission ABSENT - Chairman McCarthy ACCEPTANCE OF MINUTES - MEETING OF DECEMBER 7, 1993 Moved by Commissioner Argazzi and Seconded by Commissioner Ferraro to approve the December 7 , 1993 meeting minutes as amended: 1. Page 5 Paragraph 1 - plans should replace the word plains. 2 . Page 4 Item #1 - hay bails and silt fencing be placed at the wetlands limits. 3 . Page 2 - Commissioner Argazzi asked the applicant if he had seen the property in the spring. 4 . The following individuals names should be added: M. Gutt; L. Rubileski; C. Sikowski; A. Neiman; J. Kidd Commissioner Argazzi - yes; Commissioner Balinskas - yes; Commissioner Collis - yes; Commissioner Colburn abstain; Commissioner Daigle - abstain; Commissioner Ferraro - yes; Four yes; Two abstain - Motion is Carried to accept the minutes of the December 7 , 1993 meeting. AUDIENCE OF CITIZENS There was no participation at this time. ELECTION OF OFFICERS Commissioner Ferraro suggested this be moved to Item 2 .d. The Commission agreed to this suggestion. - 2 - REGULAR MEETING 1. APPLICATION 94-01W - Proposal by Del Favero Associates, Inc. to discharge drainage into a wetland area on Lot 4-1, Block 151, Mattabassett Street. Bart Bovee of MBA Engineering represented the applicant and Jeff Del Favero representing Del Favero Associates was also present. The applicant is proposing construction of a nine lot subdivision which is 4 .8 acres in size and would connect the existing Mattabassett Street and Mattabassett Street Extension in the East Berlin section of Town. A portion of the property lies along the Mattabassett River although no impact to the river's flood plain are being proposed. The site also contains wetlands which have been field located and lie immediately along the river's embankment. Proposed regulated activities involved the construction of a plunge pool storm drainage outlet and retrofitting of an existing catch basin into a sedimentation structure. The applicant would like to amend the application showing the drainage going into a different discharge basin than is already noted on the map presented this evening. The applicant is proposing at the flare end, at the end of the tree row, to remove two lengths of pipe and reinstall the flare end with a plunge pool as there seems to be a natural swail in this area currently. Commissioner Ferraro asked what the only impact would be. Mr. Bovee stated the only impact is at the end of the pipe as stated on the plans. Commissioner Colburn asked about a channel that went lateral to the wetlands that was established on the Alling Court subdivision. The idea of pushing it back 20 feet is fine, pushing the area back even further would be better. Mr. Bovee stated the Alling Court situation was a different situation than this subdivision. It could be explored. Commissioner Balinskas stated that Commissioner Colburn's suggestion might cause some damage in the area. Commissioner Colburn would like to see the flow of the water slowed down a bit. Mr. Horbal stated that staff can work with the applicant on the plans for the next meeting. - 3 - Moved by Commissioner Balinskas and Seconded by Commissioner Daigle to table the application until the next meeting. Commissioner Argazzi - yes; Commissioner Balinskas - yes; Commissioner Collis - yes; Commissioner Colburn - abstain; Commissioner Daigle - yes; Commissioner Ferraro - yes Five - yes; One - abstain. Motion is carried to table the application until the March, 1994 meeting. 2 . OTHER BUSINESS TO COME PROPERLY BEFORE THE COMMISSION a. Application 93-04W - Permit Extension Henry Resnikoff represented the applicant. The applicant is requesting an extension of the construction commencement period and transfer of the previously issued permit associated with Application 93-04W. The proposal initially depicted regulated activities in conjunction with the proposed health care facility located along the west side of New Britain Road opposite Magson Uniform. The plans will not be changed in regard to wetlands. There will be extensive landscaping. Commissioner Balinskas asked if there would be any other modification to the plan or the building. Mr. Resnikoff stated the applicant was going to ask the Town Planning and Zoning to modify the foot print within the area that the building is in to accommodate an interior layout. The garage and carport will probably be eliminated. Mr. Horbal suggested extending the permit and transfer the permit at the same time. Moved by Commissioner Ferraro and Seconded by Commissioner Colburn to extend the permit for Application 93-04W until February 27 , 1995 and transfer the permit at this time also. Commissioner Argazzi - yes; Commissioner Balinskas - yes; Commissioner Colburn - abstain; Commissioner Collis - yes; Commissioner Daigle - yes; Commissioner Ferraro - yes Five - yes; One - abstain. Motion Carried to extend the permit for Application 93-04W to February 27, 1995 and transfer the permit from the previous applicant to RFP, Inc. - 4 - b. Application 90-20WF - Permit Modification Paul Perlsweig represented the applicant and Jim Massirio, the applicant was also before the Commission. The applicant is requesting permission to modify a previously approved application due to construction modifications which conflict with the initial permit granted by the Commission. The applicant previously received approval to construct an addition to the Jim Massirio Home Remodeling facility located adjacent to the Mattabassett River along the north side of Mill Street. Mr. Massirio laid out the building incorrectly. Mr. Massirio did not follow the site plan as was approved by the Commission. The building is five feet closer to Mill Street and the step is larger and the handicap ramp raps around instead of coming straight out. Mr. Massirio wold like the Commission to approve the plan as is and Mr. Massirio realizes the mistake he made as he did not hire a surveyor he did it himself. Mr. Perlsweig asked the Commission to approve the plan as built as the step provides a better access in and out of the building. Commissioner Ferraro asked if the building was built in the floodway and was the building built larger than previously stated. Mr. Perlsweig stated all the buildings in the gray line area are in the floodway. Yes, the building is built within the floodway. The building was built in the wrong place but the same size. Staff expressed some concern as the step was bigger than previously presented and the ramp was not in the proper place as stated on the plan. Staff felt there was an obstruction of flow in this area as the site was not in compliance with the previously approved plans. Commissioner Ferraro asked if there was an opportunity to compensate for the additional blockage that has been installed. A suggestion was removal of some fill or grade the area to the proper height. Mr. Perlsweig stated the fill could be cut back to the parking area. Staff suggested that the applicant look into different options to correct the situations and what the cost of the options might be. - 5 - c. Correspondence The Commission addressed the situation and correspondence regarding Country Estates Subdivision. Mr. Horbal stated that he had notified the developer, Mr. Bob Dornfried, of the various complaints received by residents in the area and the problems/violations in the subdivision and how they should be addressed. Mr. Dornfried responded with a letter from his attorney. DEP has also submitted correspondence regarding the subdivision as to what should be done about the sedimentation and erosion controls. Mayor Peters submitted a letter dated January 27 , 1994 to Joseph Suranna, Zoning Commission Chairman stating that subdivision was in compliance. Mr. Horbal stated he has done everything he can regarding violations and is looking for direction from the Commission on how to handle the situation. The Commission suggested to Mr. Horbal to wait until spring and see what sedimentation and erosion controls are in place and what controls need to be established.
