1990/01/09 BERLIN PLANNING coMMISSION The regular meeting of the Berlin Planning Commission was called to order at 7:00 P.M. on January 9, 1990 by vice chairman cindy wilcox. Those present were Philip Bourgeois; George Southworth; Betty Mildrum; Gale porter, alternate seated for Dorothy Woznis; and Bill Voelker, Town Planner. 1. PUBLIC HEARING. Mr. Bourgeois read the legal notice of the publio hearing to consider the following: s. Resubdivision of Mary Ann Rusczyk for two residential building lots at Lot 74, armin ton Avenue. Lewis Mirante presented the plans. An existing Block 23H, ~emaingon the lot fronting on Farmington Avenue and the proposed house will rear lot will have a 20 foot wide strip for accems to Fsrmington Avenue. Both lots will be served by public water and sewer. Mrs. wilcox asked for comments. Charles Hoffman of IO7 Garden Drive asked if any borings had been water because there are many springs in the area and he gets athere all him life and was nev a commercial spring on Spring Street. Mr. Hoffman stated that the,rear of the lots on the lower part of Garden Drive are all full of water ~n the Mr. Mirante explained the proposed grading to be done on the rear spring, stated that the development will not add to neighboring water prob,lems lot and and would probably help the problems. David Porter of 113 Garden Drive stated that he gets water in his backyard from Mr. Russzyk's property. Vincent Lewandowski of 67 Spring Street stated that there are springs in the whole area and he had heard that a number of springs had to be capped when the homes in the neighborhood were being built. He also asked if this problem can be addressed because he is afraid that any digging in the area will alter the flow of water. Mr. Rusczyk said that he is familiar with the area and that Mr. Lewandowski's home was built almost directly on the old commercial spring. Dan Saraeeno of 49 Garden Drive stated that no one is objecting to a house being built on the property but asked if the Commission has any authority over cou~truction plans to make sure the water problem will not · x lained that staff will thoroughly review the plans increase. Rusczyk's resubdivision, Farmingtou Avenue. Mr. ~oelker statsd that comments are needed from the Police Department and Fire Marshall, and staff will discuss the conm~ents of the public. A motion was made by Mr. Southworth, seconded by Mrs. Porter and voted ~nanimously to table action. NEW BusINESS a. Final subdivision approval for Winding Meadow, Section V of A. Ciamella & Son, Inc. for 21 residential building lots off Four Rod Road. A motion was made by Mr. Bourgeois, seconded by Mrs. porter and voted unanimously to grant final subdivision approval subject to receipt of the bond to be set by staff. b. Resubdivision of Easco Corp. for two industrial building lots at Lot 6, Block 90, Four Rod Road. A motion was made by Mr. Bourgeois, seconded by Mrs. Mildrum and voted nnanimously to schedule a public hearing on Jan. 2~, 1990. OTHER COP~ISSION BusINESS a. Mr. Voelker read a letter from Mayor Peters in which he requested the Commission reconsider the requirement for sidewalks along Four Rod Road and Camel's Back ou the Majewski/Matyka property. The subject was discussed. A motion was made by Mr. Bourgeois, seconded by Mr. Southworth and voted unanimously to waive the requirement for sidewalks on Four Rod Road but to still require them on Camel's Back. Revised plans need to be submitted. b. Request for bond reduction, Kenson Company, Bishops Curve. No action was taken. c· A motion was made by Mr. Scuthworth, seconded by Mrs. Porter and voted unanimously to grant a 9D day extension for filfng of subdivision mylars, Deming Business Center, llenry Rampone. 401 d. Request for bond reduct~nn, Esther Farr. Chamberlain Highway. No action was taken. A motion was made by Mr. Bourgeois, seconded by Mrs. Porter and voted unanimously to grant a one year extenstion of preliminary approval for Vineyard Acres, Section VI. f. A motion was made by Mr. Bourgeois, seconded by Mr. Southworth and voted unanimously to approve the minutes of the December 12, 1989 meeting. g. A motion was made by Mrs. Porter, seconded by Mrs. Mildrum and voted unanimously to recommend to the Executive Board street acceptance of Magnolia Estates, Modern Age Developers. h. A motion was made by Mrs. Porter, seconded by Mr. Southworth and voted unanimously to recommend to the Executive Board acceptance of open space, Tree Hill Road, Raymond Kavarsky. i. A motion was made by Mr. Bourgeois, seconded by Mr. Southworth and voted unanimously to add this item to the agenda. A motion was made by Mr. Bourgeois, seconded by Mr. Southworth and voted unauimousiy to recommend to the Executive Board street acceptance of the extension of Glendale Avenue. Those present were Philip Bourgeois; George Southworth; Betty Mildrum; Gale Porter~ alternate seated for Dorothy Wozmis; and Bill Voelker, Town Planner. 1. PUBLIC HEARING. Mr. Bourgeois read. the ~egal notice of the public hearing to consider the following~ a. Resubdivision of Easco Corporation for 2 industrial building lots at Lot Block 90, Four Rod Road. Lewis Mirante.presented the plans. The southern 10 acres will be cut-off from the existing lot to create one new lot and the remaining R~r~s!~wil~make up the other lot with the existing industrial building. Both lots will be served by public water and sewer. Mrs. Wilcox asked for comments. Katherine Kasiski of Norton Road whose home is south of the Easco property spoke o~ water draining onto her property from Easco. She asked if this will continue and also if~;bhe hedge rowbehind her property will b~ disturbed. Mr. Mirante stated that the hedge row would not be disturbed and future development of the lot would take care of drainage. George Danko of Norton Road also has water drain onto his lot from the Easco property, he stated that this has only been happening the last 3 years after Easco dug up along the railroad tracks and filled the lot behind him. Dean Petow of 680 Kensington Road asked if the new lot is being created to sell for future industrial development, and if so, he doesn't think anymore industry is needed in the area. Mr. Mirante replied that the proposal before the Cemmission is!only to resubdivtde the property but a~y future industrial development is allowed by zoning regulations since it is in a PI zone. Peter Halibozsk of Four Rod Road agreed with Mr. Petow regardingobjections to increased industrial development in the area.' Michael Scollo of 629 Four Rod Road also objected to the proposal because he is against increased industrial use in the area. Frank Rich, an official of Easco~ clarified recent allegations of chemicals on the property of which they were found not guilty; they have not caused any contamination. Be also explained that the property is zoned PI and Easco could build on the lot immediately if they wanted, tle also stated that the company is trying to do something about the odor from the buildieg. Claudia Fiducia of 64a Four Rod Road reminded the Commission that McGee School is near-by and with more industrial development there will be increased traffic. Charlie Karno, Economic Development Director, read a letter qn behalf of the applicant requesting a waiver of the sidewalk requirement. ~he public hearing was closed at 7:20 P.M. by Mrs. Wilcox and the regular meeting res,med. OLD BUSINESS a. Easco, Four Rod Road. Mr. Voelker reviewed Section 52.04 which requires sidewalks in all commercial and industrial zones and within one mile of a s~hool. Mr. Miraote petered out that there is slot of rock along the road which would make it difficult for installation of sidewalks, also the northern portion of the property is all wetland and a permit would be needed to fill that area for sidewalks. Mr. Voelker noted that, although a "typical building" is shown on tbs map, no building is asked for or approved on this proposal. Wbeu a site plan is presented to staff and the Commission, drainage comments of the public will be addressed. A motion was made by
