2. Mr. Marlo Massirio presented the following Subdivision Plan of his property on Mill Street.
"Subdivision of Property owned by Marlo Massirio, Mill Street, Berlin, Conn., 1"=30', dated
March, 1970, Rev. April, 1971, Rev. March 1975, James F. Kissane, L.S." The following note
appeared on the map - "Lots 1SA and 15B to be provided with individual water services; iron pins
at lot corners and Town street monuments to be set by the Developer."
Mr. Massiro also agreed to deed 2 pieces of land - one adjacent to Lot 15B and the other
adjacent to Lot liB, between the proposed street line and the existing street lines to the Town.
It was voted on a motion made by Mr. Stiano, seconded by Mr. Baccaro, to approve the
subdivision subject to deeding the above mentioned parcels to the Town.
3. Agenda Item 1 - proposed subdivision property of Berlin Steel Construction - subject was
not discussed as the owners were not present.
4. Agenda Item 2 - Bond Reduction - Section3, Kramer Drive, Dalco, Inc., owner - a letter was
received from DALCO requesting that the current bond be reduced from $49,195. to $40,255 -
this reduction represents completion of water main and part of the engineering cost ($8,940.).
Mr. Seelye stated that the work has been completed to the satisfaction of the Engineering Dept.
and recommended that the request be granted. So voted on a motion made by Mr. Stiano,
seconded by Mr. Baccaro.
5. Zoning Commission Referrals -
a. Request of Economic Development Commission to change the zoning on Old Brickyard
Lane from Heavy Industry, Residential R-7, and Light Industry to Planned Industry.
The area is located approximately north of Porters' Pass, east of Farmington Ave. (rear)
southeast of the Penn Central R .R. (New Haven to Hartford line), southwest of Rte 72,
and northwest of the residential portion of Murray Heights.
It was voted on a motion made by Mr. Conti, seconded by Mr. Stiano, to recommend
that this change be granted for the following reasons -
1. Although the Town Plan of Development shows most of the area as Heavy
Industry, Planned Industry is a higher and better industrial use and is
therefore recommended.
2. If the area were in Planned Industry, this Commission would,ave site plan
approval over ail development in the area.
b. Request of Jones Loomis Co. for a zone change from R43 to Planned Industry on
Lot 34, Block 133 on Gommerce Street.
This area is located In the rear of the west side of Commerce Street about 600 feet
di stance south from the terminus of Commerce Street, and also tn the rear of the
east side of Beckley Road.
This was discussed in detail and it was voted on a motion made by Mr. Baccaro,
seconded by Mr. Conti, to recommend that the zone change be made only to the
eastern boundary of the Helco right of way for the following reasons.
Use of Planned Industry is in substantial compliance with the Town Plan
of Development.
2. Because trees cannot be planted in the Helco (or any power company) right
of way, the r-o-w cannot be used as a screening type buffer as prescribed
b~r the "Zoning Ordinan~e, and therefore, the trees and the limit of the
Industrial Zone should be at the east side of the Helco right of way.
